N\u00eb citatet kur&#8217;anore dhe n\u00eb ato t\u00eb hadithit gjejm\u00eb edhe konfirmimin e k\u00ebsaj q\u00eb themi. Nga k\u00ebto argumente jan\u00eb fjal\u00ebt e Allahut subhanehu ve teala:<\/p>\n<p>&#8220;Mos ia merrni pasurin\u00eb nj\u00ebri-tjetrit padrejt\u00ebsisht! Dhe mos u b\u00ebni mit\u00ebdh\u00ebn\u00ebs te gjykat\u00ebsit p\u00ebr t&#8217;ua p\u00ebrvet\u00ebsuar n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme dhe me vet\u00ebdije njer\u00ebzve nj\u00eb pjes\u00eb t\u00eb mallit.&#8221; (El-Bekare: 188)<\/p>\n<p>&#8220;O besimtar\u00eb, mos e p\u00ebrvet\u00ebsoni pasurin\u00eb e nj\u00ebri-tjetrit n\u00eb m\u00ebnyr\u00eb t\u00eb palejueshme, p\u00ebrve\u00e7 rastit kur ajo \u00ebsht\u00eb tregti me p\u00eblqim t\u00eb dyansh\u00ebm&#8230;&#8221; (En-Nisa: 29)<\/p>\n<p>K\u00ebto dy citate tregojn\u00eb p\u00ebr moslejimin n\u00eb asnj\u00eb m\u00ebnyr\u00eb t\u00eb shkeljeve t\u00eb t\u00eb drejtave t\u00eb pasuris\u00eb, duke p\u00ebrfshir\u00eb t\u00eb gjitha llojet e kund\u00ebrvajtjeve ndaj k\u00ebtyre t\u00eb drejtave. Allahu do q\u00eb bashk\u00ebsia njer\u00ebzore t\u00eb b\u00ebj\u00eb nj\u00eb jet\u00eb t\u00eb ndershme, t\u00eb sigurt dhe t\u00eb qet\u00eb, ku \u00e7do njeri t\u00eb ket\u00eb siguri p\u00ebr veten, nderin dhe pasurin\u00eb e tij. P\u00ebr k\u00ebt\u00eb shkak, Allahu e ka ndaluar armiq\u00ebsimin ndaj njer\u00ebzve, nderit dhe pasuris\u00eb s\u00eb tyre. Muhamedi sal-lAllahu alejhi ve sel-lem thot\u00eb: &#8220;P\u00ebr muslimanin \u00ebsht\u00eb i ndaluar gjaku, pasuria dhe nderi i muslimanit.&#8221; P\u00ebrve\u00e7 k\u00ebsaj, i D\u00ebrguari sal-lAllahu alejhi ve sel-lem n\u00eb tubimin m\u00eb t\u00eb madh njer\u00ebzor, n\u00eb haxhin lamtumir\u00ebs, ka th\u00ebn\u00eb: &#8220;Me t\u00eb v\u00ebrtet\u00eb, gjaku juaj, pasuria juaj, nderi juaj jan\u00eb t\u00eb ndaluara si\u00e7 \u00ebsht\u00eb e ndaluar kjo dit\u00eb, n\u00eb k\u00ebt\u00eb vend, n\u00eb k\u00ebt\u00eb muaj&#8230;&#8221; (Mutefekun alejhi nga hadithi i ib\u00ebn Abasit radijallahu anhuma.)<\/p>\n<p>T\u00eb gjith\u00eb musliman\u00ebt pa p\u00ebrjashtim jan\u00eb n\u00eb konsensus se marrja e pasuris\u00eb s\u00eb njer\u00ebzve dhe ngr\u00ebnia e saj n\u00eb m\u00ebnyr\u00eb t\u00eb padrejt\u00eb nuk lejohet . Kjo tregon se sa i ruan dhe i mbron sheriati islam t\u00eb drejtat e njer\u00ebzve nga padrejt\u00ebsit\u00eb, shkeljet dhe t\u00eb gjitha llojet e armiq\u00ebsive.<\/p>\n<p>Jo vet\u00ebm kaq, por Islami ruajtjen dhe mbrojtjen e pasuris\u00eb e ka b\u00ebr\u00eb nj\u00eb nga pes\u00eb gj\u00ebrat e patjet\u00ebrsueshme, ruajtja e t\u00eb cilave \u00ebsht\u00eb obligim. Nj\u00ebra nga m\u00ebnyrat q\u00eb e shkat\u00ebrron pasurin\u00eb dhe p\u00ebrmes s\u00eb cil\u00ebs kriminel\u00ebt ua marrin pasurin\u00eb njer\u00ebzve \u00ebsht\u00eb vjedhja.<\/p>\n<p>P\u00ebrkufizimi i vjedhjes \u00ebsht\u00eb marrja e pasuris\u00eb s\u00eb tjetrit n\u00eb m\u00ebnyr\u00eb t\u00eb fsheht\u00eb nga nj\u00eb vend i ruajtur. Shum\u00eb citate na t\u00ebrheqin v\u00ebrejtjen dhe k\u00ebrc\u00ebnojn\u00eb kund\u00ebr veprimit t\u00eb k\u00ebsaj vepre. Kur i D\u00ebrguari sal-lAllahu alejhi ve sel-lem merrte besatimin e atij q\u00eb hynte n\u00eb Islam, k\u00ebrkonte nga ai gj\u00ebra madh\u00ebshtore dhe k\u00ebtu hynte edhe largimi nga \u00e7do lloj armiq\u00ebsie ndaj pasuris\u00eb s\u00eb njer\u00ebzve, si\u00e7 thuhet n\u00eb hadithin e Ubadete ib\u00ebn es-Samitit: &#8220;Ishim tek i D\u00ebrguari sal-lAllahu alejhi ve sel-lem dhe na tha: &#8220;Ma jepni bes\u00ebn q\u00eb nuk do t&#8217;i b\u00ebni shok Allahut asgj\u00eb, nuk do t\u00eb vidhni dhe nuk do t\u00eb b\u00ebni kurv\u00ebri.&#8221;<\/p>\n<p>Allahu tregon besatimin e t\u00eb D\u00ebrguarit ndaj grave kur thot\u00eb: &#8220;O Profet, n\u00ebse vijn\u00eb te ty besimtaret e t\u00eb betohen se nuk do t&#8217;i shoq\u00ebrojn\u00eb Allahut asgj\u00eb (n\u00eb adhurim), nuk do t\u00eb vjedhin, nuk do t\u00eb kurv\u00ebrojn\u00eb, nuk do t&#8217;i vrasin f\u00ebmij\u00ebt e tyre, nuk do t\u00eb sjellin ndonj\u00eb shpifje t\u00eb sajuar nga ato vet\u00eb dhe se nuk do t\u00eb t\u00eb kund\u00ebrshtojn\u00eb n\u00eb \u00e7far\u00eb \u00ebsht\u00eb e drejt\u00eb dhe e arsyeshme, at\u00ebher\u00eb ti pranoje betimin e tyre dhe lutju Allahut t&#8217;i fal\u00eb. V\u00ebrtet, Allahu \u00ebsht\u00eb Fal\u00ebs dhe M\u00ebshir\u00ebplot\u00eb.&#8221; (El Mumtehine: 12)<\/p>\n<p>Vjedhja e shpie vjedh\u00ebsin n\u00eb zjarr, Allahu na ruajtt\u00eb. N\u00eb hadithin e Kusufit (namaz q\u00eb b\u00ebhet me rastin e eklipsit t\u00eb Diellit apo t\u00eb H\u00ebn\u00ebs), Xhabiri radijallahu anhu thot\u00eb: &#8220;I D\u00ebrguari sal-lAllahu alejhi ve sel-lem ka th\u00ebn\u00eb: &#8220;Ma afruan zjarrin af\u00ebr, kur m\u00eb pat\u00eb se u largova nga frika se mos m\u00eb kaplonte zjarri, derisa pash\u00eb nj\u00ebrin q\u00eb kishte nj\u00eb k\u00ebrrab\u00eb dhe bartte me vete zorr\u00ebt n\u00eb zjarr. Ai vidhte haxhiun me k\u00ebrrab\u00ebn e tij. N\u00ebse e v\u00ebrente (haxhiu), i thoshte &#8220;m\u00eb \u00ebsht\u00eb lidhur k\u00ebrraba p\u00ebr rrobe&#8221;, por n\u00ebse nuk e v\u00ebrente, vidhte at\u00eb q\u00eb donte.&#8221;<\/p>\n<p>Vjedhja \u00ebsht\u00eb nga m\u00ebkatet e m\u00ebdha dhe ai q\u00eb e b\u00ebn k\u00ebrc\u00ebnohet me zjarr. Imam Dhehebiu e ka renditur vjedhjen n\u00eb vendin e nj\u00ebzetetret\u00eb.<\/p>\n<p>V\u00ebllez\u00ebr t\u00eb ndersh\u00ebm besimtar\u00eb!<\/p>\n<p>N\u00eb k\u00ebt\u00eb vep\u00ebr bie vet\u00ebm ai q\u00eb ka besim t\u00eb dob\u00ebt dhe nuk i frik\u00ebsohet mbik\u00ebqyrjes s\u00eb Allahut, pasi besimtari q\u00eb \u00ebsht\u00eb besnik n\u00eb besimin e tij jo vet\u00ebm q\u00eb nuk e b\u00ebn k\u00ebt\u00eb vep\u00ebr, por nuk i shkon aspak n\u00eb mendje t\u00eb vjedh\u00eb. Transmetohet nga Ebu Hurejra, Allahu qoft\u00eb i k\u00ebnaqur me t\u00eb, se i D\u00ebrguari sal-lAllahu alejhi ve sel-lem ka th\u00ebn\u00eb: &#8220;Nuk b\u00ebn zina zinab\u00ebr\u00ebsi dhe gjat\u00eb zinas\u00eb t\u00eb jet\u00eb besimtar. Nuk pi alkool dhe gjat\u00eb pirjes t\u00eb jet\u00eb besimtar dhe nuk vjedh e gjat\u00eb vjedhjes t\u00eb jet\u00eb besimtar&#8230;&#8221;<\/p>\n<p>I D\u00ebrguari sal-lAllahu alejhi ve sel-lem na ka treguar se Allahu e ka mallkuar hajdutin. Nga Ebu Hurejra transmetohet se i D\u00ebrguari sal-lAllahu alejhi ve sel-lem ka th\u00ebn\u00eb: &#8220;Allahu e ka mallkuar hajdutin&#8230;&#8221;<\/p>\n<p>P\u00ebrmes gjuh\u00ebs s\u00eb Pejgamberit sal-lAllahu alejhi ve sel-lem, Allahu e ka mallkuar at\u00eb q\u00eb e shtrin dor\u00ebn e shtrenjt\u00eb e t\u00eb \u00e7muar p\u00ebr t\u00eb vjedhur gj\u00ebra t\u00eb thjeshta e t\u00eb ul\u00ebta, duke e hidh\u00ebruar Allahun tebareke ve teala.<\/p>\n<p>Kjo q\u00eb u p\u00ebrmend \u00ebsht\u00eb d\u00ebnimi i hajdutit n\u00eb bot\u00ebn tjet\u00ebr nga Allahu i Madh\u00ebruar, por pasi vjedhja ka t\u00eb b\u00ebj\u00eb me marrjen e pasuris\u00eb s\u00eb tjetrit pa t\u00eb drejt\u00eb, at\u00ebher\u00eb Allahu ka vendosur rregull dhe d\u00ebnim p\u00ebr vjedh\u00ebsin edhe n\u00eb k\u00ebt\u00eb bot\u00eb. Ky d\u00ebnim \u00ebsht\u00eb prerja e dor\u00ebs.<\/p>\n<p>Allahu thot\u00eb n\u00eb Kur&#8217;an: &#8220;Vjedh\u00ebsit dhe vjedh\u00ebses ua pritni duart, si nd\u00ebshkim p\u00ebr at\u00eb q\u00eb kan\u00eb b\u00ebr\u00eb dhe si d\u00ebnim nga ana e Allahut. Allahu \u00ebsht\u00eb I Plotfuqish\u00ebm dhe i Urt\u00eb.&#8221; (Maide: 38)<\/p>\n<p>Pra, ai q\u00eb kapet duke vjedhur dhe i plot\u00ebson kushtet e prerjes s\u00eb dor\u00ebs, at\u00ebher\u00eb udh\u00ebheq\u00ebsit e atij vendi duhet ta zbatojn\u00eb k\u00ebt\u00eb urdh\u00ebr t\u00eb Zotit. Ky rregull zbatohet n\u00eb ato vende ku gjykohet me ligjin e Allahut dhe nuk duhet t\u00eb kujtojm\u00eb se kushdo q\u00eb kap ndonj\u00eb vjedh\u00ebs ka t\u00eb drejt\u00eb ta gjykoj\u00eb, pasi ekzekutimi i nd\u00ebshkimit \u00ebsht\u00eb e drejt\u00eb vet\u00ebm e udh\u00ebheq\u00ebsve. E, n\u00ebse ata nuk e zbatojn\u00eb, at\u00ebher\u00eb m\u00ebkati bie mbi ta.<\/p>\n<p>Si\u00e7 dihet, armiqt\u00eb e fes\u00eb p\u00ebrher\u00eb jan\u00eb munduar dhe mundohen ta paraqesin Islamin si nj\u00eb fe t\u00eb vrazhd\u00eb dhe me ligje t\u00eb prapambetura e t\u00eb r\u00ebnda p\u00ebr njer\u00ebzit. K\u00ebtu kan\u00eb futur edhe prerjen e dor\u00ebs s\u00eb atij q\u00eb vjedh. P\u00ebr k\u00ebt\u00eb arsye, ne themi:<\/p>\n<p>S\u00eb pari, prerja e dor\u00ebs s\u00eb hajdutit \u00ebsht\u00eb e v\u00ebrtetuar me Kur&#8217;an, me Sunnet dhe me konsensusin e musliman\u00ebve, pra \u00ebsht\u00eb nj\u00eb gjykim dhe nj\u00eb vendim p\u00ebr t\u00eb cilin musliman\u00ebt nuk kan\u00eb kund\u00ebrshtime.<\/p>\n<p>S\u00eb dyti: Sa u p\u00ebrket shpifjeve ndaj Islamit dhe sidomos ndaj k\u00ebtij gjykimi, ne themi se Zoti \u00ebsht\u00eb i Gjith\u00ebdijsh\u00ebm dhe M\u00ebshirues, prandaj \u00e7do ligj dhe \u00e7do vendim q\u00eb ka caktuar p\u00ebr rob\u00ebrit e Tij n\u00eb Kur&#8217;an apo n\u00eb Sunnet \u00ebsht\u00eb p\u00ebr t\u00eb mir\u00ebn e njeriut dhe s&#8217;ka dyshim p\u00ebr k\u00ebt\u00eb, edhe pse n\u00eb syt\u00eb e njer\u00ebzve duket i r\u00ebnd\u00eb dhe i pap\u00ebrballuesh\u00ebm. Kjo u ngjan medikamenteve q\u00eb mjeku i jep pacientit. E dim\u00eb mir\u00eb se medikamenti \u00ebsht\u00eb i r\u00ebnd\u00eb apo i leht\u00eb n\u00eb baz\u00eb t\u00eb s\u00ebmundjes; n\u00ebse s\u00ebmundja \u00ebsht\u00eb shum\u00eb e r\u00ebnd\u00eb, at\u00ebher\u00eb edhe medikamenti \u00ebsht\u00eb i r\u00ebnd\u00eb dhe mund t\u00eb shkaktoj\u00eb ndonj\u00eb s\u00ebmundje tjet\u00ebr, por m\u00eb pak t\u00eb rrezikshme se ajo q\u00eb ka. E nj\u00ebjta gj\u00eb vlen edhe p\u00ebr \u00e7\u00ebshtjen e vjedhjes. Kur e dim\u00eb se vjedhja \u00ebsht\u00eb shkelje e di\u00e7kaje t\u00eb shenjt\u00eb dhe t\u00eb r\u00ebnd\u00ebsishme p\u00ebr njeriun, d.m.th. shkelje e pasuris\u00eb s\u00eb tij, at\u00ebher\u00eb njeriu do ta mbroj\u00eb at\u00eb me \u00e7do kusht, madje edhe me jet\u00eb. Q\u00eb t\u00eb mos arrihet deri te kjo gjendje, kur njer\u00ebzit t\u00eb vriten mes tyre p\u00ebr shkak t\u00eb pasuris\u00eb, Zoti i M\u00ebshirsh\u00ebm ka vendosur k\u00ebt\u00eb rregull, i cili \u00ebsht\u00eb i r\u00ebnd\u00eb p\u00ebr hajdutin, por i drejt\u00eb dhe i arsyesh\u00ebm sepse asnj\u00eb ligj tjet\u00ebr nuk do t&#8217;i ndalte hajdut\u00ebt dhe kriminel\u00ebt nga kjo vep\u00ebr e sh\u00ebmtuar. P\u00ebr k\u00ebt\u00eb d\u00ebshmon ajo q\u00eb shohim sot n\u00eb bot\u00eb dhe q\u00eb e jetojm\u00eb edhe n\u00eb vendin ton\u00eb.<\/p>\n<p>Nuk ka dit\u00eb q\u00eb t\u00eb mos d\u00ebgjojm\u00eb p\u00ebr thyerje dyqanesh dhe vjedhje sht\u00ebpish, por edhe vjedhje m\u00eb t\u00eb rrezikshme si vjedhja e bankave. \u00cbsht\u00eb e qart\u00eb se pasuria \u00ebsht\u00eb e aq dashur p\u00ebr hajdut\u00ebt, sa t\u00eb rrezikojn\u00eb shum\u00eb dhe t\u00eb vjedhin edhe bankat, ndon\u00ebse dihet se aty ka masa t\u00eb forta sigurie. Shtrohet pyetja: \u00c7far\u00eb e shtyu hajdutin apo grabit\u00ebsin q\u00eb t\u00eb mos ket\u00eb frik\u00eb e t\u00eb vjedh\u00eb pasurin\u00eb e njer\u00ebzve pa t\u00eb drejt\u00eb? Dy jan\u00eb gj\u00ebrat q\u00eb e kan\u00eb shtyr\u00eb dhe nuk ka t\u00eb tret\u00eb: dashuria e madhe p\u00ebr t&#8217;u pasuruar dhe d\u00ebnimi i leht\u00eb p\u00ebr at\u00eb q\u00eb kapet duke vjedhur.<\/p>\n<p>Q\u00eb pasuria \u00ebsht\u00eb e dashur dhe e r\u00ebnd\u00ebsishme p\u00ebr njeriun nuk do ta diskutojm\u00eb sepse pasuria \u00ebsht\u00eb shkak p\u00ebr nj\u00eb jetes\u00eb m\u00eb t\u00eb mir\u00eb, por do t\u00eb p\u00ebrqendrohemi te d\u00ebnimi i leht\u00eb ndaj hajdutit. Dikush mund t\u00eb thot\u00eb se kjo nuk \u00ebsht\u00eb e v\u00ebrtet\u00eb, pasi d\u00ebnimi p\u00ebr t\u00eb \u00ebsht\u00eb i r\u00ebnd\u00eb edhe te ligjet e tjera. Po pyesim, sa \u00ebsht\u00eb d\u00ebnimi m\u00eb i r\u00ebnd\u00eb p\u00ebr nj\u00eb vjedhje t\u00eb r\u00ebnd\u00eb? Dy vjet, tre vjet, pes\u00eb vjet, a arrin m\u00eb shum\u00eb se dhjet\u00eb vjet burgim? At\u00ebher\u00eb themi se ky ligj dhe ky vendim, edhe pse \u00ebsht\u00eb i r\u00ebnd\u00eb, prap\u00ebseprap\u00eb nuk arrin t&#8217;i ndaloj\u00eb njer\u00ebzit nga synimet e tyre t\u00eb k\u00ebqija p\u00ebr t&#8217;u pasuruar p\u00ebrmes vjedhjes. Arsyet jan\u00eb k\u00ebto:<\/p>\n<p>1) D\u00ebnimi \u00ebsht\u00eb i leht\u00eb dhe jo i dhimbsh\u00ebm p\u00ebr hajdutin.<\/p>\n<p>2) Ligji p\u00ebr pages\u00ebn e burgimit, q\u00eb \u00ebsht\u00eb nj\u00eb arsye shum\u00eb e madhe q\u00eb njer\u00ebzit t\u00eb vjedhin edhe m\u00eb shum\u00eb.<\/p>\n<p>3) Jetesa e mir\u00eb n\u00eb burg, pasi hajduti nuk m\u00ebrzitet kur futet n\u00eb burg sepse b\u00ebn jet\u00eb t\u00eb mir\u00eb, prandaj preferon q\u00eb t\u00eb rrezikoj\u00eb t\u00eb pasurohet p\u00ebrnj\u00ebher\u00eb p\u00ebrmes vjedhjes. N\u00ebse jo, at\u00ebher\u00eb nuk e sheh si shum\u00eb t\u00eb keqe jet\u00ebn n\u00eb burg. Por sikur ta dinte se do t&#8217;i pritej dora po t\u00eb kapej, at\u00ebher\u00eb nuk do t\u00eb guxonte t\u00eb vidhte, madje as mendja s&#8217;do t&#8217;i shkonte.<\/p>\n<p>Ka edhe shum\u00eb gj\u00ebra p\u00ebr t&#8217;u th\u00ebn\u00eb, por dua ta p\u00ebrfundoj duke theksuar se n\u00ebse sheh ligjet e tjera, p\u00ebrpos ligjit t\u00eb Allahut, sheh se nuk e kan\u00eb mbrojtur t\u00eb drejt\u00ebn e pasuris\u00eb, por vet\u00ebm sa kan\u00eb nxitur q\u00eb t\u00eb ket\u00eb m\u00eb shum\u00eb vjedhje dhe shkelje me d\u00ebnimet e tyre t\u00eb lehta, t\u00eb cilat madje nuk i kan\u00eb zbatuar. Ata nuk e kan\u00eb realizuar q\u00ebllimin e vendosjes s\u00eb k\u00ebtyre d\u00ebnimeve, pasi e kan\u00eb rrezikuar dhe d\u00ebmtuar m\u00eb shum\u00eb pasurin\u00eb e njer\u00ebzve.<\/p>\n<p>N\u00eb an\u00ebn tjet\u00ebr, shohim se ligji dhe vendimi i Islamit p\u00ebr hajdutin \u00ebsht\u00eb nj\u00eb ligj i drejt\u00eb dhe i m\u00ebshirsh\u00ebm p\u00ebr njer\u00ebzit sepse b\u00ebn q\u00eb pasuria e njeriut t\u00eb jet\u00eb e ruajtur dhe njer\u00ebzit t\u00eb jetojn\u00eb n\u00eb rehati e begati. Ky \u00ebsht\u00eb Islami madh\u00ebshtor, q\u00eb me ligjet e veta b\u00ebn q\u00eb njer\u00ebzit as t\u00eb mos mendojn\u00eb p\u00ebr vepra t\u00eb sh\u00ebmtuara. Por kur shum\u00eb vende islame filluan t\u00eb ndjekin per\u00ebndimor\u00ebt n\u00eb ligjet e tyre, at\u00ebher\u00eb t\u00eb nj\u00ebjtat dukuri q\u00eb ishin tek ata filluan t\u00eb p\u00ebrhapeshin edhe te musliman\u00ebt.
